1. Purpose
This Acceptable Use Policy ("AUP") sets out the standards for acceptable and unacceptable use of the OptEva platform. This AUP applies to all Users, Company Administrators, and anyone accessing the Platform on behalf of a Company.
2. Permitted Uses
OptEva may be used only for the following legitimate business purposes:
- Managing property listings and their progression through the sales pipeline
- Recording and managing buyer and seller contact information
- Linking buyer interests to relevant properties and tracking enquiry status
- Uploading and managing documents related to contacts and properties
- Setting reminders and follow-ups for legitimate business activities
- Synchronising business reminders with Google Calendar
- Managing team members and their access to business data
3. Prohibited Conduct
Users must not:
3.1 Unlawful Activities
- Use the Platform for any unlawful purpose or in breach of any South African law, including POPIA, FICA, the Competition Act, or the Electronic Communications and Transactions Act (ECTA)
- Input personal information obtained unlawfully or without appropriate consent/legal basis
- Use the Platform to facilitate money laundering, fraud, bribery, or any corrupt activity
3.2 Security Violations
- Attempt to gain unauthorised access to other companies' data within the multi-tenant system
- Attempt to bypass, disable, or circumvent any security measure of the Platform
- Share login credentials with unauthorised persons
- Use the Platform to deploy malware, conduct phishing, or attempt denial-of-service attacks
- Probe or scan the Platform for security vulnerabilities without written authorisation from MPK Development
3.3 Data Misuse
- Use personal information captured in the Platform for purposes unrelated to legitimate real estate business activities
- Export and sell or transfer contact data to third parties without the knowledge and consent of the data subjects
- Use the Platform to build or maintain a database for purposes prohibited by POPIA or the applicable Estate Agency legislation
3.4 Platform Integrity
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform
- Introduce automated scripts, bots, or scrapers to interact with the Platform
- Overload Platform infrastructure through excessive automated API requests
- Misrepresent your identity or impersonate another user
4. Reporting Violations
Users who become aware of a violation of this AUP should report it to their Company Administrator or directly to MPK Development at info@opteva.co.za. Reports will be treated in confidence.
5. Consequences of Violation
Violation of this AUP may result in:
- Immediate suspension of the offending user's account without notice
- Termination of the Company's access to the Platform
- Reporting to relevant authorities (Information Regulator, SAPS, EAAB) as required by law
- Civil or criminal proceedings
6. Amendments
MPK Development may update this AUP with 30 days notice. Continued use of the Platform constitutes acceptance of the revised AUP.
